Snus contains tobacco, and EU law bans its sale in every member state except Sweden. Nicotine pouches contain no tobacco, so that ban does not apply to them: each country sets its own rules instead. For a distributor, the first test is simple. If the product contains tobacco leaf, you cannot stock it for the EU market.

We produce tobacco-free nicotine pouches and nicotine-free caffeine pouches in the EU and sell them in 20+ countries. We do not produce snus. This guide sorts out the names suppliers use and the rules that decide what you can stock, as of October 2026.

What is the legal difference between snus and nicotine pouches?

The difference is tobacco. Under EU law snus is a tobacco product and a nicotine pouch is not, even when the two look the same in the can.
The Directive defines tobacco for oral use as products made wholly or partly of tobacco (Article 2(8)). A pouch without tobacco falls outside that definition. The European Commission's 2021 report on the Directive acknowledges that it does not fully cover oral nicotine pouches.

Why can't snus be sold across the EU?

Article 17 of the Directive requires member states to ban placing snus on the market. Sweden's exemption stops at its border, and a wholesale contract does not change that.

    Sweden keeps snus on a condition

    Its 1994 Accession Treaty allows snus in Sweden only, and Sweden must stop it reaching other member states. A Swedish ordinance bans taking snus from Sweden to other EU countries, with an exception only for travellers' personal quantities.

    The Court has upheld the ban twice

    The Court of Justice of the EU confirmed it in 2004 and again in 2018 (Case C-151/17).

    Relabelling doesn't work

    In Case C-425/17 the Court limited "chewing tobacco" to products that can properly be used only by chewing. A tobacco sachet held in the mouth rather than chewed does not qualify, even if it is sold as a "chewing bag"; national courts apply that test to each product.

    Enforcement is real

    In October 2025 German customs seized more than 14,000 cans of snus from a warehouse in Dortmund.

Outside the EU, snus is legal in Norway and Switzerland under their own rules. The UK bans it.

Why does "all white snus" on a price list mean nicotine pouches?

Today "all white snus" is almost always a trade name for tobacco-free nicotine pouches. The word "snus" in it is market habit, not a legal category. Customs and regulators look at the ingredients.

Many suppliers, including some with "snus" in their company name, use the word for any oral pouch. Two lines on the same price list can look almost identical and sit on opposite sides of the law:
The white portion format is tobacco snus, as Swedish Match's own guide describes it. The "all white" name also started as a description of colour: one of the first products sold as all white, in the mid-2010s, was made from washed tobacco. The name alone proves nothing.

Where can you sell snus and nicotine pouches in Europe?

Of the markets in this guide, snus is legal in three: Sweden, Norway and Switzerland. Nicotine pouches are legal in most of the EU, but five EU markets in the table below don't allow them and many others cap nicotine content.
Status as of October 2026. Limits are written the way each law states them, per pouch or per gram.
If you sell into several countries, build the range around the strictest one, or plan separate SKUs per market.

What changes in 2026 and 2027?

Most changes tighten strength and flavour rules rather than ban the category. Plan SKUs about a year ahead.

  • EU: the Commission published its evaluation of the tobacco rules on 2 April 2026 and plans to propose a revision of the Directive in 2026.
  • EU excise: the July 2025 proposal to tax nicotine pouches EU-wide had not been adopted as of October 2026.
  • Poland: a government bill would allow tobacco flavour only. It enters into force 6 months after publication.
  • Spain: a royal decree on nicotine caps and flavours awaits approval, with a transition period after adoption.
  • Estonia: a draft sets 4 mg/g and tobacco or menthol flavour only from 1 January 2028.
  • France: the EU Court of Justice will rule whether France may also ban production, import and export of pouches.

What should a distributor stock instead of snus?

Stock tobacco-free nicotine pouches matched to each market's limit. Where nicotine pouches are banned, nicotine-free caffeine pouches are an option if food rules allow them.

Two things to check before the first order:

Per-pouch caps against the spec sheet. A limit in mg/g and a limit in mg per pouch are different tests. Whether a 16 mg/g product passes Denmark's 9 mg per pouch cap depends on the pouch weight.

Food supplement rules for caffeine pouches. They fall outside nicotine law, so national supplement notification, caffeine limits and labelling apply. Bavaria's food safety office found breaches of food or medicines law in all 18 nicotine-free pouches it tested up to November 2025, so check notification in your market first.

Snus and nicotine pouches: FAQ

It depends on the country, not on the name. All white snus is a tobacco-free nicotine pouch, so the EU snus ban does not apply to it. It follows each country's pouch rules: legal with a strength cap in Denmark, Finland or Poland, banned in the Netherlands, Belgium and France. Check the ingredient list, because "white portion" products contain tobacco.
